PANDORA WINS KEY RULING IN PATENT INFRINGEMENT CASE
Biagi Found Guilty of Copying Charm Bracelet, Necklace Design

Columbia, Md. (May 26, 2009) — On May 6, 2009, a Federal District Court in Florida ruled in favor of PANDORA in a patent infringement case against Biagi and Cappola Capital Corporation, Biagi’s parent company. The court found that Biagi’s jewelry designs infringe on PANDORA’s patented jewelry system (U.S. Patent 7,007,507) used in the design of its charm bracelets and necklaces.

“The court system has set an important precedent in protecting PANDORA’s patented jewelry system against Biagi, or any other would be infringers,” said John White, general manager, North America, PANDORA. “We are very pleased with the decision, and intend to continue to vigorously defend our patent design.”
White added, “Our goal is to ensure that when our customers buy PANDORA, they know they’re buying the original.”

As a result of the court ruling, anyone selling the copy-cat Biagi jewelry products would be considered a patent infringer. Any sales of that Biagi jewelry would be liable for damages.

The court’s decision moves the three-year long action to defend PANDORA’s design against infringement closer to an end. In August, a judge will determine the monetary damages that will be awarded to PANDORA.

The infringement suit against Biagi centers on PANDORA’s unique system that allows charms to be arranged on our bracelets and necklaces in the order desired by our customers. The Florida court decided that Biagi’s jewelry copies all the elements of PANDORA’s patented jewelry system.
